In Canada, the requirements for becoming a surrogate are designed to ensure the health and safety of both the surrogate and the child. Below are the key criteria:

1. Age

  • Surrogates are generally required to be between 21 and 45 years old to ensure they are physically capable of carrying a pregnancy to term safely.

2. Previous Pregnancy

  • Surrogates must have had at least one previous, uncomplicated pregnancy and childbirth, confirming their ability to carry and deliver a baby.

3. Physical Health

  • The surrogate should be in good physical health with no history of medical conditions that could complicate the pregnancy.

  • A healthy Body Mass Index (BMI) is often required.

4. Mental Health

  • Surrogates must undergo a psychological evaluation to ensure they are mentally and emotionally prepared for the surrogacy process.

5. Lifestyle

  • The surrogate must lead a healthy lifestyle, avoiding smoking, alcohol, and drugs during and before the pregnancy.

6. Residency

  • Surrogates must reside in Canada and be legal residents or citizens. The laws and regulations governing surrogacy vary between provinces, and surrogacy agreements are affected by where the surrogate lives.

7. Support System

  • A surrogate must have a strong support network (family, friends, or partners) who can provide emotional and practical help throughout the pregnancy.

8. Legal Understanding

  • The surrogate must have a clear understanding of the legal implications and responsibilities of surrogacy. Independent legal advice is usually required to ensure she is fully informed about her rights.

9. Altruistic Intent

  • In Canada, surrogacy must be altruistic, meaning the surrogate cannot be paid for carrying the child. However, she can be reimbursed for reasonable expenses related to the pregnancy (e.g., medical costs, maternity clothes, etc.).

10. Criminal Background Check

  • A criminal background check may be required to ensure the safety and well-being of the intended parents and the child.

11. Willingness to Follow Medical Protocols

  • The surrogate must agree to undergo all necessary medical procedures, including IVF, embryo transfer, and regular prenatal check-ups.
